The Department of Commerce (DoC), Shared Services Procurement Office (SSPO)—formerly known as Enterprise Services-Acquisition (ES-A)—is implementing a low-risk initiative to address a backlog of over-age, expired contracts. This special notice, identified by solicitation number 1331L524-ES-A-LowRiskCloseouts, outlines a streamlined procedure to clear the contract file backlog, which currently burdens legacy systems and complicates the transition to modernized financial and procurement platforms. The agency aims to expeditiously close these actions and deobligate undelivered obligation (UDO) amounts using risk-based management principles.
The initiative targets contracts meeting specific low-risk criteria, including those where the performance period expired by the end of Fiscal Year 2020, those with no invoice activity within the past 12 months that expired by the end of Fiscal Year 2024, or fixed-price and certain time-and-materials contracts expiring by the end of Fiscal Year 2025 with a UDO balance of $10,000.00 or less. The specific contracts subject to these procedures are detailed in the two attached files: ES-A_Low Risk Closeout List.xlsx and SSPO_Low Risk Targeted Closeout List.xlsx.
Contractors with agreements identified on these lists are requested to submit any outstanding invoices to the cognizant invoicing office by the response deadline of April 30, 2026. Beginning May 1, 2026, the SSPO anticipates implementing unilateral deobligation and closeout procedures for the identified contracts. While the agency intends to move forward with these streamlined actions, contractors maintain their rights to file claims under the Contract Disputes Act of 1978, and the government will adhere to standard contract file retention requirements following the closeouts.
